Plan documents. The benefit plan descriptions contained in the online Summary Plan Descriptions summarize the main features of the Company's benefits program, and are not intended to amend, modify or expand the plan provisions. In all cases, the provisions of the plan document, master insurance contract or trust agreement control the administration and operation of the plans.
Plan funding. Contributions for the benefit plans described in the summary plan descriptions are made by employer and employee contributions. The funding of these plans is insured and self-insured, as noted on the Directory Of Plans.
Discretionary authority of plan administrator and plan fiduciaries. The Plan Administrator has the authority, in its discretion, to make such rules, regulations, interpretations, and computations and to take other such actions to administer the plans as it deems appropriate. This includes the discretion to interpret eligibility for benefits and benefit payment. For the fully insured plans, however, the applicable Insurance Company has the discretion and authority to determine benefits under the contract. All decisions of the Plan Administrator are final and binding.
Plan year. The Plan Year for purposes of accounting and all reports to the DOL and other regulatory bodies starts each January 1 and ends each December 31.
Plan records. Plan Documents, Annual Reports and Summary Plan Descriptions are filed with the Internal Revenue Service (IRS) and U.S. Department of Labor for each plan.
Copies of the plan documents and annual reports are available upon written request to the Plan Administrator.
Plan Administration. The Plan Administrator is responsible for the proper administration of the plan according to the terms of ERISA and any documents or contracts. The Plan Administrator generally supervises the operation of the plan, and may delegate any or all of this authority to a claims administrator. To the extent that authority is delegated, the claims administrator has all of the power and authority of the Plan Administrator.
Contact For Legal Matters. If it becomes necessary for a participant to take legal action because of a dispute relating to the plan, you may contact the agent for service of legal process under the plan. You may also serve legal process to the Plan Administrator.
